Already Foreclosed?
You are here because the mortgage company has already foreclosed on your Alabama home.
Most of our foreclosure cases involve clients who came to see us after a foreclosure.
But, if you are like most people, you have been told the following (often falsely):
- It is too late to do anything because all of your claims disappear when you are foreclosed;
- It is too late to do anything because a judge has already ruled on the foreclosure;
- It is impossible to fight the mortgage companies because they are too powerful;
- There are no laws to help consumers in Alabama fight against wrongful foreclosures; and
- Mortgage companies will never undo a foreclosure, restore your loan, make changes to a credit report, and pay money when they have been caught in a wrongful foreclosure.
Keep in mind who is telling you that you have no options.
Is it the mortgage company that has engaged in massive fraud across the country? Not too reliable, eh?
Is it the real estate agent hired by the mortgage company to convince you to leave your home? Gotta love it when these guys start giving you legal advice. Hmmm…. sounds like the unauthorized practice of law.
Is it well meaning friends and family who don’t know what the law is?
Is it a bankruptcy lawyer who is correct that you cannot reverse the foreclosure with a bankruptcy but is incorrect that you have no litigation options (assuming the mortgage company committed wrongful acts against you)?
Our suggestion is that you learn about your rights from Alabama lawyers who sue mortgage companies.
You may very well have options to fight back against the mortgage companies.
- Did the mortgage company lie to you before the foreclosure?
- Did the mortgage company add bogus fees that pushed you into a foreclosure?
- Did the mortgage company improperly apply your payments to pay for late fees, bogus inspection charges, etc?
- Did your mortgage company even have any legal right to foreclose?
- Did your mortgage company properly notify you and properly advertise the foreclosure in accordance with Alabama law?
- Did your mortgage company properly conduct the actual foreclosure?
- Did your mortgage company violate the Fair Debt Collection Practices Act (FDCPA) before, during or after the foreclosure?
Knowing the answers to these questions can help you decide if you have a valid claim against the foreclosure company.
It will also help you if you have been sued (discussed here) by the mortgage company for what is known as an ejectment lawsuit — a lawsuit to eject (or evict) you from your home and to obtain money damages against you.
